Man found dead was registered sex offender: Police identify body discovered on Hall Road as James Alan Smith, 46, of Buckhannon

BY PAUL FALLON

The body of a man found dead along the Hall Road Saturday afternoon has been identified by Upshur County law enforcement as James Alan Smith, 46, of Buckhannon.

Smith was found dead along the Hall Road at approximately 3 p.m. Saturday. Upshur County Chief Deputy Mike Kelley referred to the death as "suspicious" during a phone interview Monday.

Smith had a troubled past, having been convicted of second degree sexual assault of a female family member in 1992, according to the W.Va. State Police sex offender registry. Smith served approximately eight years and three months in a correctional facility after being convicted.

He is listed on the W.Va. State Police sex offender registry, which can be accessed online.

According to the registry, Smith had been convicted of assaulting a female between the ages of 0 and 5 years old.

Kelley said Smith's body could have been lying along the road since as early as 11 p.m. Friday night. He added that no missing person report had been filed on Smith. A passerby spotted the body Saturday and called 911, Kelley said.

Smith's body has been sent to the state medical examiner's office in Charleston. The cause of death has not been released. Kelley stated that more information could be forthcoming, saying the cause of death could be released this afternoon or in the next couple of days.

"The investigation is still ongoing," Kelley said.

Upshur County Deputy Theron Caynor is the lead investigator.
